Terms of Use

1. The Service

PatentLab provides AI-powered tools for patent search, prior art analysis, filing assistance, patent valuation, blockchain marketplace listing, litigation risk assessment, and related intellectual property intelligence ("Service"). The Service is provided on an "as is" and "as available" basis.

2. Not Legal Advice

PatentLab is an AI-powered service platform. Nothing on the platform constitutes legal, financial, or patent prosecution advice. AI-generated analysis, claim drafts, valuations, or strategies are tools to assist your work — not professional opinions. Always consult a qualified patent attorney or financial advisor before making intellectual property decisions.

3. Your Account

• You must be at least 18 years old and capable of forming a binding contract.
• You are responsible for maintaining the confidentiality of your login credentials.
• You agree to provide accurate, current information and notify us of any unauthorised access.
• One account per person; no shared accounts.

4. User Content

You retain ownership of any documents, inventions, or data you upload or create on PatentLab. By uploading content, you grant us a limited, non-exclusive, royalty-free licence to process, store, and display that content solely for the purpose of providing the Service to you. We do not claim ownership of your intellectual property.

5. Blockchain & Smart Contracts

PatentLab enables patent listing and licensing via smart contracts deployed on the Polygon blockchain. Blockchain transactions are irreversible. You are solely responsible for verifying all transaction details before execution. PatentLab does not control the Polygon network and is not liable for network failures, gas fee fluctuations, or wallet errors.

6. Prohibited Uses

• Using the Service for any unlawful purpose or in violation of applicable Indian law.
• Reverse engineering, decompiling, or attempting to extract source code or AI models.
• Uploading malware, infringing content, or material that violates third-party rights.
• Automated scraping, crawling, or bulk data extraction without prior written consent.
• Impersonating another person or entity.
• Attempting to circumvent credit or subscription limits.

7. Payments & Credits

• Payments are processed securely via Razorpay. We do not store card details.
• All prices are in Indian Rupees (INR) and inclusive of applicable taxes.
• No refunds on consumed AI credits, activated subscription periods, or completed transactions, except where required by applicable law or at our sole discretion in case of documented platform error.
• Subscription plans auto-renew unless cancelled before the renewal date.
• We reserve the right to adjust pricing with 30 days' notice.

8. Limitation of Liability

To the maximum extent permitted by law, Oceanext Solution Pvt Ltd's total liability for any claim arising from use of the Service shall not exceed the amount you paid to us in the three (3) months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, or consequential damages, including loss of profits, data, or business opportunities.

9. Intellectual Property

The PatentLab platform, its design, code, trademarks, and AI models are the exclusive property of Oceanext Solution Pvt Ltd. You may not copy, reproduce, or create derivative works without our explicit written permission.

10. Termination

We may suspend or terminate your account at any time for breach of these Terms or misuse of the Service, with or without notice. You may close your account at any time from your profile settings. Upon termination, your right to use the Service ceases immediately.

11. Governing Law & Disputes

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts at Kolkata, West Bengal. We encourage you to contact us first to resolve any dispute amicably.

12. Changes to These Terms

We may update these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Service after changes constitutes your acceptance of the revised Terms.
